2. Description of Service

TaleWhisper is an AI-powered mobile application that generates personalized bedtime stories for children. Our service includes:

• AI-generated stories with custom illustrations
• Support for 6 languages
• Voice recording functionality
• Child profile management
• Story library and favorites
• Subscription-based premium features

3. User Accounts

3.1 Account Creation

To use TaleWhisper, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental/guardian consent
• Not share your account with others
• Notify us immediately of any unauthorized use

3.2 Parental Consent

By creating child profiles, you confirm that you are the parent or legal guardian and have the authority to provide consent for the child's use of the App.

4. Subscriptions and Payments

4.1 Subscription Plans

TaleWhisper offers the following subscription tiers:

• Free: Limited features with 4 stories per month
• Premium ($7.99/month): Up to 3 children, 10 stories per child/month, AI-generated images
• Premium+ ($12.99/month): Unlimited children, 20 stories per child/month, custom themes

4.2 Billing and Renewal

• Subscriptions automatically renew unless cancelled
• Payment is charged at the beginning of each billing cycle
• All subscriptions include a 7-day free trial for first-time users
• Prices are subject to change with 30 days notice

4.3 Cancellation and Refunds

• You may cancel your subscription at any time through your device's app store
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused features
• Free trial cancellations before the trial ends will not result in charges

5. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to hack, reverse engineer, or compromise the App
• Share, sell, or redistribute generated stories commercially without permission
• Upload malicious code or viruses
• Impersonate others or provide false information
• Violate any laws or regulations
• Use the App to generate inappropriate or harmful content

6. Content and Intellectual Property

6.1 Generated Stories

Stories generated through TaleWhisper are created using AI. While you have the right to use these stories for personal, non-commercial purposes, the underlying technology and algorithms remain our intellectual property.

6.2 User Content

You retain ownership of any content you create or upload (e.g., voice recordings). By using the App, you grant us a limited license to use this content solely to provide our services.

6.3 TaleWhisper Property

All App content, features, functionality, trademarks, logos, and branding are owned by TaleWhisper and protected by copyright, trademark, and other intellectual property laws.

7. Content Moderation

TaleWhisper uses AI to generate stories. While we strive to ensure all content is age-appropriate and safe for children:

• We cannot guarantee that all generated content will be appropriate
• Parents should review stories before sharing with children
• You can report inappropriate content to us for review
• We reserve the right to filter, modify, or remove content at our discretion

8. Privacy

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT:

• The App will be uninterrupted, secure, or error-free
• Generated stories will be suitable for all children
• The App will meet your specific requirements
• Any errors or defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALEWHISPER SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Damages arising from use or inability to use the App
• Content generated by AI systems

Our total liability shall not exceed the amount you paid for the subscription in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless TaleWhisper from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share

12. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Fail to pay subscription fees
• Request account deletion

Upon termination, your right to use the App ceases immediately, and we may delete your data in accordance with our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use after changes constitutes acceptance of the new Terms.
